2. User eligibility for the Site and accessibility of the Site

By accessing the Site, the user (hereinafter referred to as the “User”) acknowledges that he/she has read and accepted these Site Terms and Conditions and undertakes to comply with them. In the absence of acceptance, the User is invited to interrupt all browsing on the Site.

Château Montrose reserves the right to modify these Terms and Conditions at any time, in order to take account of any technological, commercial or legislative developments, and consequently leaves it to its Users to refer to them regularly, the date mentioned at the top of these Terms and Conditions indicating their most recent update.

To browse the Site, Users must be legally authorised to consume or purchase alcohol in their country of residence.

Château Montrose also reserves the right to deny access to the Site to any User who has made or may make fraudulent use of the Site.

The Site is accessible to Users at all times. However, it may be decided to interrupt the Site for technical maintenance purposes. In this case, Château Montrose will make every effort to inform Users of the dates and times of the intervention beforehand.

3. Site content

The purpose of the Site is to provide information about all of Château Montrose’s activities.

All information on the Site is given for information purposes only and may be updated or modified. Château Montrose cannot guarantee that the information is complete.

Although Château Montrose endeavours to provide information on the Site that is as accurate as possible, it cannot be held responsible for any omissions, inaccuracies or failure to update information, whether these are its fault or that of third-party partners who provide it with this information.

4. Intellectual property rights

Intellectual property rights, in particular trademarks, images, graphics, drawings, logos, texts, sounds, software constituting and/or appearing on the graphic interface of the Site, as well as all components and content of the Site, whether registered or not, are and shall remain the exclusive property of Château Montrose throughout the world or of any third party having granted it a licence.

Consequently, any reproduction, representation, modification, publication, total or partial adaptation of the elements of the Site, for whatever reason and on whatever medium, is prohibited without the express prior written consent of Château Montrose.

Any unauthorised use of the Site or of any of the elements it contains will be considered as constituting an infringement in accordance with the provisions of the French Intellectual Property Code.

By accessing and browsing the Site, the User acknowledges that the intellectual property rights belong to Château Montrose or to any third party who has licensed them to the User, and undertakes to refrain from infringing them in any way whatsoever, anywhere in the world.

5. Personal data and cookies

Château Montrose complies with all laws and regulations applicable to the use of cookies on the Site and to the protection of personal data, in particular the General Regulation on the Protection of Personal Data (n°2016/679) and law n°78-87 of 6 January 1978 relating to information technology, files and freedoms.

Château Montrose may use cookies placed on Users’ computers. A cookie does not allow the User to be identified, but records information relating to the browsing of his/her computer on the Site. The data obtained in this way is intended to facilitate subsequent browsing of the Site and is also used to measure the number of visitors to the Site.

Refusal to install a cookie may make it impossible to access certain services. However, Users can configure their computer to refuse the installation of cookies.

6. Hypertext links

Château Montrose may set up hypertext links on its Site to other resources available on the Internet, in particular social networks such as Facebook or Instagram, as well as sites where its products can be purchased. However, Château Montrose cannot be held responsible for the content, operation and terms of use of sites to which the User may have access via these hypertext links. In any event, Château Montrose reserves the right to remove at any time any hypertext link leading to content that is inappropriate and/or contrary to its principles or values.

Simple or deep hypertext links to the Château Montrose Site may only be created with the prior written authorisation of Château Montrose, which may be revoked at any time. Château Montrose therefore reserves the right to request the immediate removal of any hypertext link, whether simple or deep, to the Site, without having to justify such a request. The User is expressly informed of the fact that any third-party sites offering hypertext links to the Site are not under its control, and Château Montrose declines all responsibility for their access and content.

7. Responsibility of Château Montrose

The User acknowledges that Château Montrose may not be held liable for any indirect and/or unforeseeable damage to the User or to any third party, resulting from accessing and/or browsing the Site, including financial or commercial damage, loss of profits, anticipated savings, customers, data, attractiveness and reputation of the User.

In accordance with articles 2 and 3 of these GCU, Château Montrose declines all responsibility for any lack of accessibility to the Site or any interruption, as well as for any omission or inaccuracy in the information published on the Site.

Contact forms are available to Users. Château Montrose reserves the right to delete, without prior notice, any content posted in this space that contravenes applicable French legislation, in particular provisions relating to data protection. Where applicable, Château Montrose also reserves the right to hold the User civilly and/or criminally liable, particularly in the event of messages of a racist, insulting, defamatory or pornographic nature, whatever the medium used (text, photographs, etc.).

8. Applicable law and jurisdiction

These GCU shall be governed by and construed in accordance with French law, unless otherwise provided by mandatory provisions.

The courts within the jurisdiction of the Bordeaux Court of Appeal will have territorial jurisdiction to hear any dispute, including disputes relating to the use of the Site, without prejudice to the User’s right to bring the matter before the courts of the place of his or her habitual residence or the place where the harmful event occurred, in accordance with the applicable solutions for settling conflicts of jurisdiction, including the Code of Civil Procedure and the Consumer Code, or the Brussels 1 bis Regulation.
